When using this website (‘Website’) or any of its services and forms, ZETA AUDIOVISUAL, S.A.U. (hereinafter, “ZETA”) collects the personal data of each user (the ‘User’) in accordance with the Legal Notice. 2. Information collected on the Website

2.1. ZETA collects various information from Users, which is not always provided directly by the User who accesses, registers or interacts on the Website and which differs depending on the form used (hereinafter, ‘Personal Data’):


(i)    Contact Form: through this form, ZETA collects the following information directly from the User who contacts us: name, email address and message.


2.2.    Likewise, ZETA may record Users' visits to the Website, the use that Users make of the Website and its links, or when the User clicks on content, interacts, or otherwise makes use of the Website.  


2.3. Under no circumstances is it necessary for Users to include sensitive information or data, such as ethnic or racial origin, political opinions, religious or philosophical beliefs, or trade union membership, data relating to health or data relating to sex life, sexual orientation, or data relating to criminal records.

3. Use of data and legal basis


3.1. The precise manner in which ZETA uses Users' Personal Data will ultimately depend on each User's use of the Website.

 
3.2.    ZETA will use Personal Data to study the User's navigability and usability of the Website, and, in particular, collecting data on:

4. Who has access to User data? Who are the recipients?

5. Data retention

5.1. ZETA retains most Personal Data for as long as necessary to fulfil the purposes indicated above. Once these purposes have been fulfilled, ZETA will retain the Personal Data, blocked, to the extent that liabilities may arise for the Company or in any other way that is legally required.

As far as possible, the information will be anonymised once the User has closed their account. In particular:

6. Where is Personal Data stored?

6.1. ZETA collects, stores and processes Users' Personal Data on different servers. When using Google Workspace services, data is mainly stored in the European Economic Area, but may be transferred to Google LLC in the United States or other third countries. Such international transfers are carried out under the EU Standard Contractual Clauses and other appropriate safeguards provided by Google, which has also adhered to the EU-US Data Privacy Framework approved in July 2023, in compliance with the General Data Protection Regulation (GDPR).


7. Representations and warranties

7.1. Users warrant that the Personal Data provided is true and accurate and undertake to notify any changes or modifications. They shall be liable for any loss or damage caused to the Website, ZETA, any entity of the ZETA group, or any third party through the communication of erroneous, inaccurate or incomplete information.


8. Security of Users' Personal Data


8.1. ZETA is concerned about the security and protection of its Users' Personal Data and endeavours to prevent any security breaches that may occur.


8.2. To this end, ZETA adopts and applies the necessary technical and organisational measures to guarantee the confidentiality, integrity and security of personal data, and to prevent its loss, alteration, unauthorised processing or access, taking into account the state of technology and the nature of the data stored. ZETA also periodically monitors its systems to detect possible vulnerabilities and attacks. 

8.3.    However, Users are aware that Internet security is not impregnable and that there is no guarantee that data cannot be accessed, disclosed, altered or destroyed if there is a breach in any of the security measures in place. 


9. Exercise of Users' rights


9.1.    In accordance with applicable legislation, Users who have provided their Personal Data may request to exercise their rights of access to Personal Data, rectification or erasure, restriction of processing, objection to processing, as well as the right to data portability, and withdraw their consent by sending a written notification to: proteccion.datos@zetastudios.com.

 
a)    Access to data. Users may access their Personal Data at any time and request information regarding the processing of their data. 
b)    Rectification of data. Users shall have the right to request the rectification of Personal Data that is inaccurate or incomplete.
c)    Restriction of data processing. Users shall have the right to request the restriction of the processing of their Personal Data when legally established. 
d)    Objection to processing. Users may object to the processing of their Personal Data when legally established.  
e)    Data portability. Users shall have the right to receive their Personal Data in a structured, commonly used and machine-readable format, and to transmit it to another data controller.
f) Withdraw consent. Users may withdraw their consent at any time, when this is the legal basis for processing. Withdrawal of consent shall not affect the lawfulness of processing based on consent prior to its withdrawal.


9.2.    If necessary for the unambiguous identification of the User, ZETA may request a copy of the User's national identity card, passport or other valid identification document, in the cases established by law.


9.3.    In any case, Users may also lodge a complaint with the competent supervisory authority, in this case, the Spanish Data Protection Agency through its website.


10. Changes to the Privacy Policy


10.1. ZETA reserves the right to modify this Privacy Policy in accordance with new legislative or regulatory requirements, for security reasons or in order to adapt said policy to the instructions of the supervisory authorities in relation to data protection or to new processes. 


10.2.    When significant changes are made to this Privacy Policy, Users will be notified via the Website to give all Users the opportunity to review the changes and, if necessary, accept them before they take effect.
